Terms of Sale — Original Paintings

These terms apply when you buy an original painting by Artis Berkmanis on art-is-artis.com, by email or in person. Prints and other print-on-demand products are covered by our general Refund policy and Terms of Service. Where these terms differ, these terms apply to original paintings.

1. Seller

Original paintings are sold by SIA "Art-is-Artis", registration number 40203738391, VAT number LV40203738391, address: "Vecdzintari", Glūdas pag., Jelgavas nov., LV-3040, Latvia. Email: studio@art-is-artis.com.

2. What you buy

  • Each painting is a unique original, handmade and signed by the artist. Size, year and technique are stated on the painting's page.
  • Every original comes with a certificate of authenticity signed by the artist.
  • Photographs are taken with care, but colour and texture can look slightly different on screen and under different lighting.

3. Copyright and reproductions

You buy the physical painting only. Copyright and reproduction rights stay with the artist. The artist and SIA "Art-is-Artis" may continue to photograph the work and to make and sell reproductions of it, for example posters and canvas prints. You may photograph and show the painting you own for private, non-commercial purposes.

4. Prices

  • Prices are in euro and include 21% Latvian VAT.
  • Delivery costs are shown at checkout or agreed with you before payment.
  • For deliveries outside the European Union, any import duties and taxes in the destination country are paid by the buyer.

5. Order and payment

  • The contract is concluded when we confirm your order by email.
  • You can pay by card at checkout or by bank transfer. If you choose bank transfer, you receive an invoice and the painting is reserved for 5 working days. If payment is not received in that time, we may cancel the order and offer the painting to someone else.
  • A VAT invoice is issued for every sale.
  • Ownership of the painting passes to you once full payment has been received.

6. Delivery and collection

  • Original paintings are packed by us and sent from Latvia. They are not made or shipped by our print-on-demand partners.
  • We send the painting within 5 working days after payment, unless we agree on another date.
  • Latvia: Omniva parcel locker, courier or collection by appointment.
  • Other countries: insured courier. We confirm the price and the expected delivery time before payment.
  • The risk of loss or damage passes to you when you, or a person you name, receive the painting.
  • Please check the package on delivery. If it is damaged, note this with the courier and send us photos within 48 hours.

7. Right of withdrawal (14 days)

If you are a consumer and bought the painting at a distance (online, by email or by phone), you may withdraw from the contract within 14 days of the day you receive it, without giving a reason.

  • To withdraw, send a clear statement to studio@art-is-artis.com before the 14 days end. You may use the form below, but you do not have to.
  • Return the painting in the same condition and in suitable packaging within 14 days of telling us. You pay the direct cost of returning it. For large works, ask us for a cost estimate before you buy.
  • We refund all payments, including the standard delivery cost, within 14 days of receiving your withdrawal notice. We use the same payment method you used. We may wait to refund until the painting is back with us or you show proof that you sent it.
  • You are responsible for any loss of value caused by handling the painting more than needed to inspect it.
  • The right of withdrawal does not apply to commissioned works made to your specifications, or to purchases made in person at an exhibition or studio.

I hereby give notice that I withdraw from my contract for the purchase of the following painting: [title] / Ordered on [date] / Received on [date] / Name / Address / Date / Signature (if on paper).

8. Conformity and complaints

  • If the painting you receive differs from its description, you have the rights given by Latvian consumer law, including the right to have the problem fixed or to get your money back.
  • Please tell us within 2 months of discovering the problem, at studio@art-is-artis.com, with photos and your order number. We reply within 15 days.
  • Small differences that come from the handmade nature of the work, or from screens and lighting, are not a defect.
  • These terms do not limit your statutory rights as a consumer.

9. Commissions

Commissioned works are agreed individually. The price, deposit, timeline and approval steps are confirmed in writing before work starts. See Commissions.

10. Your data

We use your details only to process the purchase, deliver the painting, issue the invoice and certificate, and meet our accounting obligations. See our Privacy policy.

11. Governing law and disputes

These terms are governed by the laws of the Republic of Latvia. We will try to solve any complaint directly with you first. Consumers can also contact the Consumer Rights Protection Centre of Latvia (ptac.gov.lv) or a court. If you live in another EU country, this does not take away the protection given to you by the mandatory law of that country.
